摘要：

本文回溯日本的规划立法与空间规划体系演变，分析相关事权划分、横向协同与层级传导、规划体系运行的法律保障等问题。在此基础上，结合国家治理体系与治理能力现代化建设的背景，探讨对我国国土空间规划改革和制度建设的若干启示，包括：完善法律法规体系，规范国土空间规划的编制和实施；合理设置各级政府的规划事权，强调层级传导的同时注重激发基层的治理活力；精简总体规划的内容，明晰编审事权，重视规划的协同机制等。

Abstract：

This paper explains the background of Japan’s unitary system of government and local autonomy, traces back the evolution of Japan’s planning legislation and spatial planning system, and analyzes relevant issues such as the division of powers, horizontal coordination and hierarchical transmission, and the legal guarantee for the operation of the planning system. On this basis, combined with the background of the modernization of national governance system and governance capacity, this paper discusses some enlightenment to the reform and institutional construction of China’s spatial planning, including improving the system of laws and regulations, standardizing the compilation and implementation of spatial planning; the planning authority of governments at all levels should be set reasonably, emphasizing the transmission at different levels and stimulating the governance vitality at the grassroots level; simplifying the content of the master plan, clarifying the power of compilation and review, and attaching importance to the coordination mechanism of the plan, ect.
